The Act is a complex statutory instrument which lawfully allows the interference of the proprietary rights of another owner’s property.  In essence, it legalises what has traditionally been at common law unlawful.

 

With a practical structure that enables the reader to quickly understand the complexities of interpreting the Act challenging the myths and misunderstandings to provide clarity with propositional interpretations supported by clear and concise explanations and where appropriate, established legal precedents.

About the Author

Mr Philip Antino BSc (Hons) MSc MRICS CIOB is a chartered building surveyor specialising in the Party Wall etc. Act 1996. Having 15 years experience at the coal face of party wall matters which have created some defining legal cases, Philip has lectured at various seminars for organisations across the country. He is currently in his fourth year of his professional doctorate, “A case study of conflicting interpretations of the Party Wall etc. Act 1996 by surveyors in England and Wales”. He has his own surveying and building consultancy practice in Chelmsford, Essex.
